<p>GDPR is just for large corporate? Right??<br>Wrong!!!</p>



<p>GDPR impacts anyone who holds, controls or processes personal data and that includes Schools.<br>In fact – because Schools retain the personal data of children (including those under the age of digital consent) and often hold Sensitive Medical data– GDPR is particularly relevant to them.</p>



<p>Should schools be concerned?<br>Absolutely – there is a feeling within some circles that if we ignore GDPR for long enough – it will disappear, or that it is the new Y2K problem – but in both instances, that is not the case.<br>If your school’s preparation is not yet underway – time is ticking in advance of the May 25 deadline for compliance.</p>



<p>What are the key questions for my School?</p>



<p>• What is GDPR: GDPR significantly changes data protection law in Europe, strengthening the rights of individuals and increasing the obligations and responsibilities for Schools in how they collect, use and protect personal data.<br>• Why should we be concerned: GDPR protects the personal data of everyone – which includes both School Staff, Parents &amp; Most importantly – School Children – much of the focus has been on the penalties for non compliance but the real advancement here is the rights each of us have with regard to our personal data.<br>• Who needs to comply: Anyone who holds or processes personal data – this means both the School &amp; 3rd party processors and contractors who might come into the school environment must be GDPR Compliant.<br>• What type of areas with schools might need review? Lots actually – for example – How the School obtained the data, how they store and distribute personal data, how they manage sensitive data such as Children’s Data or Medical Data, the security of their data systems (Printers/IT Systems/CCTV/Data Disposal etc)<br>• From a practical point of view – what are the essential steps Schools will need to take to become compliant:<br> Awareness – Schools should familiarise themselves with GDPR, the requirements, impacts, responsibilities and obligations (Optima Training provide training courses customised for Schools &amp; Education)<br> Accountability – The School should complete a Data Audit – focussing on the Data they retain, indicating how they obtained it, for what purpose is it retained, how long they need it for and how secure they store it<br> Communication – How does the School inform people of how they obtain data – what media do they use to communicate their Privacy Policies &amp; Notices<br> Personal Privacy Rights – Does the school comply with the rights that exist for their personal data – Accuracy, Fairly Obtained, Duration of Storage, The Non Transfer of data to 3rd parties etc<br> Data Access Requests – The School must put systems in place for provide access to the data subject of their own data – within 30 days and typically free of charge<br> Reviewing the Legal Basis for Holding Data – What data is collected and for what specific legitimate purpose?<br> Consent: Does the School have clear, unambiguous, documented and opt-in consent from the data subject for the person data which it collects or communicates?<br> Children’s Data – The school must pay particular heed to the data they hold on children (and Medical data – which is considered “Sensitive”<br> Risk Assessments – The School should implement systems for Data Privacy Impact Assessments &amp; Privacy by Design &amp; Default to ensure ongoing compliance<br> Data Breaches – The School should develop a Data Breach Procedure and implement the procedure if and when a data breach occurs – notifying the Data Protection Commissioner within 3 days<br> Point of Contact – The school should nominate a point of contact who will assist and advise staff and families with GDPR, who will monitor compliance who might be a Data Protection Officer<br>• How do I find out more? <p>Although hotel safety is not assured, there are many things that you can do to prevent possible crime&nbsp;and misconduct via these tips and our related Training Courses which are delivered in Limerick, Cork, Dublin, Waterford &amp; Galway</p>



<p><strong>1. Check-In –&nbsp;</strong>Avoid staying in a room on the bottom floor, it’s too easy to break into. According to Independent Traveler, “many safety experts recommend staying somewhere between the third and sixth floors – where rooms are high enough to be difficult to break into, but not so high that they’re out of the reach of most fire engine ladders.”</p>



<p><strong>2. Leave the TV or Radio On –&nbsp;</strong>Leave the TV or radio on when you leave your hotel room. This will give off the impression that you are inside which should send away any unwanted guests.</p>



<p><strong>3. Lock Your Door –&nbsp;</strong>Lock all deadbolts, security chains and metal security locks. Regardless to how long you plan on leaving your room, never leave your door a pinch open.</p>



<p><strong>4. Use Your Hotel Safe –&nbsp;</strong>Protect your valuables and make use of your hotel room safe. Lock up your lap top, expensive jewelry and other things you are not taking out with you.</p>



<p><strong>5. Use Your Do Not Disturb Sign&nbsp;–&nbsp;</strong>Regardless to if you are in the room or out, always keep the do not disturb sign on your doorknob. This will give dangerous individuals the impression that you are in the room.</p>



<p><strong>6. Don’t Set Your Credit Card on The Check-In Counter&nbsp;–&nbsp;</strong>You are making it way too easy for a thief to glance over and steal your information. Also, always make sure that after payment, upon receiving your credit card, it is your card and not a fake one given back to you.</p>



<p><strong>7. Place a Flashlight by the Bed – </strong>&nbsp;Anything can happen, and in the occurrence of a power outage you may need to navigate your way out of your hotel building. According to the National Fire Protection Association, “in an average year, one of every 12 hotels or motels reported a structure fire.” Always come prepared.</p>

<p>When it comes to writing a health and safety policy, many people are keen to find a health and safety policy example they can copy.</p>



<p>However, one size doesn’t fit all, and it’s vital that your written policy is tailored to meet the unique requirements of your organisation. With this in mind, rather than showing you how to write a health and safety policy document, we have put together a simple checklist illustrating the sort of things that need to be included. Your written health and safety policy should consist of three parts:<br>1. A general statement of intent <strong>–&nbsp;</strong>This should outline in broad terms the organisation’s overall philosophy in relation to the management of health and safety, including reference to the broad responsibilities of both management and the workforce.<br>2. Organisation (people and their duties) – This outlines the chain of command in terms of health and safety management e.g. who is responsible for whom and for what, what is the accountability protocol to ensure delegated responsibilities are undertaken and how is policy implementation monitored.<br>3. Arrangements (systems and procedures) – This deals with the practical arrangements by which the policy will be effectively implemented.</p>



<p>These include:</p>



<ul class="wp-block-list"><li>Safety training</li><li>Safe systems of work</li><li>Environmental control</li><li>Safe place of work</li><li>Machine / area guarding</li><li>Housekeeping</li><li>Safe plant &amp; equipment</li><li>Noise control</li><li>Radiation safety</li><li>Dust control</li><li>Use of toxic materials</li><li>Workplace Monitoring</li><li>Medical facilities and welfare</li><li>Internal communication / participation</li><li>Accident reporting and investigation</li><li>Emergency procedures</li></ul>

<p>A pan-European survey has found that legal compliance is the major reason why Irish businesses manage occupational health and safety.<br>The ESENER-2 (European Survey of Enterprises on New and Emerging Risks) survey on new and emerging risks, which was published recently, found that the drivers for OSH management in Ireland were legal compliance (83%), maintaining an organisations reputation (79%), avoiding fines from labour inspectorates (74%), meeting employees’ expectations (68%) and maintaining or increasing productivity (53%).</p>
